6.  PRESENTATION ON SLIGO EUROPEAN VOLUNTEERING CAPITAL FOR 2017:

Ms. Harkin, M.E.P. and Ms. Ciara Herity, Manager of Sligo Volunteer Centre were present to provide Members with an update on “European Volunteering Capital 2017”.

Mr. Hayes, Chief Executive, wished to be associated with the welcome to Ms. Harkin and Ms. Herity and the congratulations on their achievement and noted it is the first time that an urban population the size of Sligo has achieved this honour.

It was pointed out that previous winners of recognition were Barcelona, Lisbon and London.

The role of the Steering Committee was identified as

 

  • Design a programme of events
  • Actively pursue sponsorship and
  • Public awareness.

 

The Cathaoirleach and Members wished to be associated with the congratulations extended. 

In noting that no funding was available at present for the programme of Events, they expressed the opinion that every effort would be made by Ms. Harkin and the Staff in the Volunteer Centre to obtain the necessary finance.  The Members also assured the Staff involved of their support in their endeavours.

 

7.  MONTHLY MANAGEMENT REPORT FOR APRIL 2016:

It was agreed by the Members to note the Monthly Management Report for April 2016.

 

8.  TAKING IN CHARGE – DEVELOPMENT KNOWN AS “MEADOWBANK”, GEEVAGH:

9.  DATE FOR SPECIAL MEETING TO CONSIDER THE DRAFT COUNTY SLIGO DEVELOPMENT PLAN 2017-2023:

“To hold a Special Meeting to consider the Draft County Sligo Development Plan, 2017-2023 at 10.00 a.m. on Monday, 27th June, 2016”.

Following a request, it was agreed to provide hard copies of the plans/documents.

Ms. Clarke advised that they would be circulated to Members before the end of the current week.

 

10.  REPORT ON TAXATION OF SPECIAL RESOLUTION FUND:

Ms. P. Guckian outlined the background to the report which had been circulated to the Members and replied to queries raised by Members.

The Chief Executive added that this is a serious issue for Sligo County Council in that the cost to the Council is in the region of a quarter of a million Euro.  It is a cost that has been incurred despite following Departmental guidelines to the letter.  This is not impacting solely on Sligo County Council but on other Councils also.  This had been raised with the Department, while they issued the guidelines they are maintaining that the tax compliance is a matter for the Council.

The Chief Executive is currently engaging with the Department in the context of the Financial Plan, particularly in relation to the conditions imposed on Sligo County Council.  In negotiating the Financial Plan, he had challenged a condition whereby the Council would have to make up a shortfall in the event of externalities such as this but he was required to accept the condition or forfeit the additional €1m in Local Government Fund allocation.  The Chief Executive suggested that this issue would also be taken up by the Deputation in the event that they meet with the Minister.  Mr. Hayes said he would be asking that Sligo County Council would not be held liable or penalised by the Department withdrawing the said €1m.

Councillor Gormley enquired whether there had been any feedback from the request for a meeting with the Minister and Mr. Hayes confirmed that no meeting date has been confirmed.

“To contact our Dáil Deputies requesting them to arrange a meeting immediately between the Minister for Housing, Planning and Local Government, Mr. Simon Coveney, T.D. and a deputation from Sligo County Council”.

In response to a query as to the sequence of dates regarding the notification, Ms. Guckian clarified that the County Council was contacted in late 2015 seeking a list of payments made.  The Audit took place in March 2016.

Mr. Hayes added that he had raised this matter at a national level with the C.C.M.A.  A number of other local authorities had also been contacted by the Revenue Commissioners.  

Following further clarification of queries raised by Members, the meeting was advised that Mr. Hayes expects to meet with the Department before the end of June.  This meeting is in the context of a review of the Financial Plan and he has advised them that he will also be raising this matter at those discussions.

 

11.  PRESENTATION ON GOVERNANCE ISSUES/LOBBYING:

13.  REPORT ON PERFORMANCE INDICATORS 2014:

14.  DATE FOR SPECIAL MEETING ON HOUSING:

It was agreed by the Members to hold a Special Meeting to discuss matters relating to Housing at 10.00 a.m. on Monday, 11th July, 2016.

 

15.  NOMINATION TO BOARD OF N.U.I.G.:

Councillor Bree sought clarification as to which Board the vacancy had arisen on and whether the Council been had been advised that a vacancy has arisen. 

Councillor Seamus Kilgannon confirmed that he had resigned his position as the Council’s representative on the Governing Body of N.U.I.G.  Members had elected him to this post at a Special Meeting held on 11th January, 2016.  The term had been for a five year period, commencing on 1st February, 2016.

Members agreed that following consultation with the offices of N.U.I.G. and, if all the necessary documentation was in place, this matter could be added to the Agenda for the forthcoming A.G.M. of the Council scheduled for 20th June.

 

16.  APPOINTMENT OF TOWN TWINNING COMMITTEE:

It was noted that a meeting of this Committee had been arranged for Friday, 17th June.  Members agreed that, if possible, the Committee should comprise of both cross Party and cross county representation of interested Members.

17.  SEWERAGE TREATMENT PLANT AT CORPUS CHRISTI ESTATE:

“That we be provided with a report as to who is responsible for the maintenance and general upkeep of the grounds that the sewerage treatment plant at Corpus Christi Estate is built on”.

Mr. T. Kilfeather advised the Meeting that the Corpus Christi estate in Tourlestrane was developed by the Banada Development Association.

There are also 3 no. Council owned houses at the end of the cul-de-sac. It is understood that the Banada Development Association carries out general ground maintenance in the estate. However, we will endeavour to further investigate with Banada Development Association any issues regarding the maintenance of the Grounds and Open spaces at the Sewerage Treatment Plant.

 

18.  SAFETY REVIEW AT PIERS AND SLIPWAYS:

“Ask the Director of Services to review safety at piers and slip ways in the county”.

Mr. Kilfeather advised the Members that the Council’s Structures and Marine Section and the Area Engineers will be asked to examine piers and slipways to see if it is considered that there are any safety issues at these locations.

 

19.  TRAFFIC CALMING MEASURES ON R297 – MAIN STREET, ENNISCRONE:

“Ask the Director of Services to allocate funding towards traffic calming measure on R297 Main Street, Enniscrone”.

The Area Engineer and the Road Design Section have been requested by Mr. Kilfeather to examine Main Street, Enniscrone with a view to identifying appropriate traffic calming measures. 

An application can then be made to the Department of Transport for funding under the 2017 L.C.A.S. programme.

 

20.  WILD ATLANTIC WAY – STRATEGIC INFRASTRUCTURE AND ENVIRONMENTAL ASSESSMENT:

With the agreement of the Members, the following motion submitted by Councillor S. Maguire was deferred to the Agenda of the July Meeting:

“Seeks a report as to the strategic infrastructure and environmental assessment undertaken regarding the development of the Wild Atlantic Way”.

 

21.  TAKING IN CHARGE – LISSADELL PARK, OXFIELD ROAD, CARNEY:

“I wish to propose that Sligo County Council initiate the process of taking in charge Lissadell Park Housing Estate, Oxfield Road, Carney.”

Ms. Clarke advised the meeting that Sligo County Council has not received a taking in charge application for this development.  It is understood that the original Developer is in receivership.  There are outstanding issues with the development and it is proposed to draw down the Bond to carry out repairs.

 

ITEMS 24 AND 25 ON THE AGENDA:

At the request of Councillor Henry, the Cathaoirleach and Members agreed to take items 24 and 25 on the Agenda at this time.

 

24.  REQUEST FOR INTRODUCTION OF PAY EQUALISATION:

AND AGREED

“Calls on Sligo County Council to write to the Minister of Public Expenditure and Reform Mr Paschal Donohoe TD, requesting him to introduce pay equalisation for new entrants into public sector positions such as teachers, nurses, Gardaí, civil servants etc.

These new entrants should be paid at the same pay scale as their colleagues serving at the same grade if carrying out the same duties”.

 

25.  EXTENSION OF FOOTPATH AND LIGHTING ON R296 BALLYMOTE TOWN:

“Asks Sligo County Council to assess and attain a quote for the costs of the works needed to extend the footpath and lighting from Ballymote town to the factories on the R296 with a view to having it included in the 2017 scheme of works or to seek funding from relevant Departments for such a project.

Mr. Kilfeather advised the Members that Sligo County Council received a quotation last year for extending the footpath/drainage/ public lighting to the factories on R296.  The estimated cost is €75,000 approximately.  If the scheme is to go ahead in the future, tenders will be sought again at that time.

This proposal can be considered for funding during the preparation of the 2017 Schedule of Municipal Works for Ballymote-Tobercurry Municipal District (along with a number of other schemes that are proposed).

 

22.  DEPARTMENT OF SOCIAL PROTECTION PAYMENTS:

“Sligo County Council supports the call for a halt to plans to pay welfare money directly to Banks and away from Post Offices nationwide”.

 

It was agreed by the Members to deal with items 23 and 26 at this time.

 

23.  &  26.  INCREASE IN MOTOR INSURANCE PREMIUMS AND PAYMENT OF MOTOR INSURANCE RATES BY RETURNING MIGRANTS:

“That Sligo County Council recognises the financial pressure being placed on drivers because of the large increases in insurance premiums and further recognises that young people and those living in rural Ireland are particularly affected.

This Council also expresses its disbelief at the lack of explanation for those increases and the inconsistencies evident in the dramatic increase across the industry.

Sligo County Council now calls on the Central Bank, the Insurance industry and the Oireachtas to give this issue the priority it deserves and expresses our shock at the complete lack of focus on this issue in the Programme for Government.”

“Sligo County Council calls on the new Government to ensure that returning migrants do not have to pay sky high motor insurance on their return to this country”.

 

27.  REQUEST FOR PEDESTRIAN CROSSING IN COLLOONEY:

Seconded by Councillor M. Baker

AND AGREED

“That Sligo County Council Engineering staff review the traffic system on the main street of Collooney and assess the feasibility of a pedestrian crossing at a suitable location on the main street of Collooney in the interests of Health & Safety”.

Mr. Kilfeather advised the meeting that the traffic on Main Street Collooney travels slowly due to parking on both sides of the street which leaves a narrow space for vehicles to travel. The number of pedestrians crossing at particular locations is relatively low and it is difficult to say where a pedestrian crossing could be located that would be used a lot by pedestrians. The necessary provision of sight-lines at any new pedestrian crossing would also reduce parking spaces on the street.

Members were further advised that Sligo County Council Engineering Section will look at the traffic situation at this location.

 

28.  GARDA STATIONS AND POLICING IN COUNTY SLIGO:

“That Sligo County Council call on the Minister for Justice and the Minister for Finance to immediately address the following,

  1.  The re-opening of Garda Stations closed in County Sligo
  2. The urgent need for increased numbers of Garda out Policing in County Sligo
  3. The urgent need for a new updated Garda Station in Sligo fit for purpose”.

29.  &  37.  TRAFFIC CALMING WORKS ON N59 AND SPEED LIMIT ON N59 FROM BURKE’S STAIRS FACTORY TO DROMARD POST OFFICE:

“To consider the following 4 locations on the N59 for speed control.

  1. Corhownagh Church Ballyisodare move the speed limit in the Ballina direction to give protection to the Church.
  2. The speed limit on the Sligo side of Dromore West to be moved towards Sligo 200 metres to give protection to the Churchill junction.
  3. The speed limit on the Sligo side of Corballa or Castleconnor church to be moved 200 metres in the Sligo direction.
  4. The speed limit at Skreen and Dromard community centre”.

“To call on Sligo County Council to assist locals in the Skreen-Dromard area who are concerned about the urgency for reduced speed limits along the N59 from Burkes Stairs factory to below Dromard Post office. 

This stretch of road has many community facilities located along the main road and which are used daily. The speed of traffic along this stretch of road is of major concern to people living in this area who attend the Community Centre, Sports field, Playground, Running track, Health Centre, Church, Cemetery, Post Office and other facilities. The safety of Motorists and Pedestrians going to and returning home from these facilities must be improved and in light of the National Speed Limit Review 2015-2017 which is currently under review”.

A Review of Speed Limit Bye-Laws for the County has commenced in accordance with the Department of Transport Guidelines for setting and managing Speed Limits in Ireland, the Members were advised by Mr. T. Kilfeather, Director of Services.

The T.I.I. is doing a review of speed limits on National Roads and their recommendations will be considered as part of the process.

When the draft speed limits are published the public and other bodies may make submissions for consideration.

 

30.  ROAD WORKS ON TUBBERCURRY TO MOYLOUGH ROAD – R431:

“I will ask the council to apply for a “low cost accident scheme” grant to carry out road widening and bend removal works on the Tubbercurry to Moylough road, No 431, as a matter of urgency and in the interest of road safety”.

The Members were advised by Mr. Kilfeather that if land could be acquired to carry out the improvements there, an application for funding under a Low Cost Safety Improvement Scheme could be forwarded to the Department of Transport.

 

31.  U.K. VOTE ON CONTINUED MEMBERSHIP OF THE E.U.:

“That this Council supports the Irish Government in its call on the electorate of the U.K. to vote in favour of continued membership of the E.U. on June 23rd next.”

Following a discussion on this motion, a vote resulted as follows:

The Leas-Cathaoirleach deemed the motion carried.

 

32.  SIGNAGE FOR “LOOP OF SOUTH SLIGO” OFF THE WILD ATLANTIC WAY:

Seconded by Councillor D. Mulvey

AND AGREED

“In order to encourage more tourists to visit the South Sligo region, I ask that extra signage be erected to create a “loop of South Sligo” off the Wild Atlantic Way, so that the ever increasing number of tourists on the Wild Atlantic Way will visit the many wonderful attractions in South Sligo and stay longer in the county as a whole.”

Ms. D. Clarke replied to this motion and advised the meeting that Sligo County Council is committed to the tourism promotion of the county as a whole.

In addition to supporting the successful delivery of the Wild Atlantic Way, which primarily follows the county coastline, Sligo County Council can include the above proposal for consideration in the development of a future County Tourism Strategy. Suggested initial areas for consideration prior to submission include the determination of the various route options, route selection according to various modes of travel, walking, cycling and by car/bus etc. and specific points of interest to visitors.

An overall strategic approach to a potential series of loop routes eg. Yeats trail, Glencar loop, Gleniff Horseshoe Valley, Ladies Brae, de Cuellar Trail etc. will form part of strategic planning in any future County Tourism Strategy.

It was recommend following the recent establishment of a tourism sub-committee within the Rural Economic Development Zone (REDZ) in South Sligo that it advise on South Sligo Loop route options and points of interest, prior to their submission to a future Strategy.

No funding has been identified in current Council adopted budget to implement a loop of South Sligo signage design and installation programme.

The use of technology, such as utilizing the website www.sligotourism.ie and allied social media ensure the whole county and any emerging dedicated South Sligo Loop route can also be actively promoted.

Several Members raised concerns regarding this issue, Mr. Hayes advised the meeting that there is no doubt tourism is extremely important to Sligo.  The Chief Executive had made a presentation to the Sligo Tourism Board and the outcome is that there is some work going on behind the scenes and a full report will be brought to the next meeting. Sligo Tourism has been tasked with compiling a strategy for tourism in the county.  It will have to be decided what issues are focused on, e.g. Stately homes, the loop referred to in the motion, etc.  This matter will come back before the Members and it was agreed to discuss this further at that time. 

 

33.  UPDATE ON TAKING IN CHARGE OF ESTATES –

- SANDY COVE, STRANDHILL,

- THE HAWTHORNS, CARRAROE AND

- KEVINSFORT HEATH, STRANDHILL ROAD:

“I am requesting that Sligo Co Council provide a full update on the current situation in relation to the “Taking in Charge” of the following estates: Sandy Cove, Strandhill; The Hawthorns, Carraroe and Kevinsforth Heath, Strandhill Road”.

Ms. D. Clarke reported as follows:

  1. Sandy Cove, Strandhill – TIC 133
    The Council made a full claim on the planning bond for this development.  Liberty Mutual Insurance Company have had the works carried out to our satisfaction.  However, there remains an issue with Irish Water concerning a wayleave between two properties.  The costs involved in establishing the wayleave are still not resolved with Irish Water.   
      
  2. The Hawthorns, Carraroe – BN 171
    No Taking in Charge application has been made by the developer (Burke, O’Brien and Leyden) of this estate.  We made a claim on the bond of €31,340.00 on the 20th May, 2016 for a number of outstanding issues (i.e. Public lighting and road repairs).  
      
  3. Kevinsfort Heath – TIC 43 
    A valid TIC application has not been lodged to date (i.e. A Pro-forma application was submitted.

In noting the reports submitted by Ms. Clarke, it was agreed by the Members that

 

  1. Sligo County Council would write to Irish Water expressing their dissatisfaction at the rate of Taking in Charge of Estates.  The issue with Irish Water of way leaves is the only impediment to the Estate being taken in charge at Sandy Cove, Strandhill.
  2. The Enforcement Section of Sligo County Council would write to the Developer of “Kevinsfort Heath” and request the making of a formal application for the taking in charge of the Estate.
  3. The Enforcement Section of Sligo County Council would also write to the Developers of “The Hawthorns”, Messrs. Burke, O’Brien and Leyden.

 

Members enquired about the scale of fees payable with an application for the taking in charge of Estates and the basis for same.

In reply, Ms. Clarke indicated that she would circulate a copy of the relevant policy document to the Members.

35.  REPORT ON SLIGO COUNTY COUNCIL’S PROMOTION OF WILD ATLANTIC WAY:

Members agreed that the matter of a Civic Reception for Mr. McGowan would be examined by the incoming Cathaoirleach.

35.  REPORT ON SLIGO COUNTY COUNCIL’S PROMOTION OF WILD ATLANTIC WAY   (CONTINUED):

Ms. D. Clarke reported that Sligo County Council is committed to the promotion of tourism in the county as a whole.  Tourism is a significant economic driver which has the potential to stimulate significant job creation in the County into the future.

Sligo County Council acknowledges, welcomes and supports the recent publicity and efforts generated by the successful efforts of Mr. David McGowan to deliver a decommissioned aircraft by sea- to Enniscrone.

The promotion and marketing of the WAW as a brand is part of the remit of Tourism Ireland at an international level.  The key markets currently concentrated on by Tourism Ireland are the U.S., U.K., Germany and France.  Fáilte Ireland as Tourism Ireland (National Tourism Development Authority) retains overall responsibility for the WAW brand roll out and awareness promotion nationally.

Sligo has seven of the overall 169 No. WAW Discovery Points (DP) situated along the route of the WAW, namely:

  1. Enniscrone
  2. Easkey
  3. Aughris
  4. Strandhill
  5. Rosses Point
  6. Streedagh
  7. Mullaghmore-Signature Discovery Point

Sligo County Council has been involved in the installation of these Discovery Points within the past year which have been funded by Fáilte Ireland, and has been very active in pursuing potential tourism product offerings ranging from new trail and walk developments along or adjacent to the route,

In addition, business promoters doing or targeting business focusing on the Wild Atlantic Way are eligible to participate in a range of training, mentoring, marketing (including through social media), online trading vouchers for businesses becoming involved in or enhancing their online trading presence (subject to some restrictions) and other programmes available from the Local Enterprise Office. ”.

 

36.  ALLOCATION FOR CLASS 3 COUNTY ROADS:

39.  ASSISTANCE TO “GILLIGAN’S WORLD FIELD OF DREAMS” TOURIST ATTRACTION IN BELRA, LAVAGH:

“To ask Sligo County Council to provide any assistance available to the owner of Gilligans World Field of Dreams Tourist attraction Belra, Lavagh, Co. Sligo. This wonderful Tourist attraction in South Sligo may be in its final season this summer. 

I am seeking assistance towards the continued success of this centre and to ensure it will be kept open. Gilligans World Field of Dreams attracts 1000s of visitors each year and helps to support the economy of rural towns such as Tubbercurry, Coolaney, Cloonacool and Ballymote”.

Ms. D. Clarke advised Members that Gilligan’s World is a private business operating in Lavagh, Co. Sligo.  While the business would not qualify for financial assistance from the Local Enterprise Office, it is eligible for the range of other supports provided through the office, for example training, mentoring, on-line sales interventions, loans provided through the office by Micro Finance Ireland and so on.  Gilligan’s World might contact the business adviser in the Local Enterprise Office who will be glad in the first instance to discuss the issues facing the business in detail.

 

40.  CORRESPONDENCE TO MINISTER FOR AGRICULTURE RE. DAIRY CRISIS:

With the agreement of the Members, the following motion submitted by Councillor J. Queenan was deferred to the Agenda of the July Meeting:

“To call on the Minister for Agriculture to address the dairy crisis:

  1. To underpin price paid to Farmers  and
  2. To investigate why the Processors and big Supermarkets have not passed on price reduction to the Consumers”.   

 

41.  REQUEST FOR EARLY MORNING RAIL COMMUTER SERVICE:

“Sligo County Council calls on Irish Rail and the Department of Transport to seriously consider providing a light rail early morning commuter service from Carrick-on-Shannon to Sligo to arrive at MacDiarmada Station at 8.30am and return at 6.30 p.m.”.

It was noted that, following a resolution agreed by Members earlier this year regarding a service from Longford to Sligo, correspondence had been received from the Chief Executive of Iarnród Éireann, Mr. David Franks.  Mr. Franks had indicated that “the delivery of this service is operationally possible however there is a significant cost associated with such a proposal”.

Members agreed that it was important to submit the above resolution as there is such a demand for same.

 

42.  LIGHTING IN CAR PARK AT ST. NATHY’S HALL, MULLINABREENA:

“To request Sligo County Council to provide two numbers lights at the car park of St Nathy’s Hall, Mullinabreena in the interest of public safety”.

Due to the current financial position of Sligo County Council, Mr. Kilfeather advised the meeting that the erection of new public lights is not considered possible at this time.

 

43.  JOINT TRADE MISSION - ENTERPRISE IRELAND AND I.D.A.:

“Cognizant of the enhanced role of local authorities in terms of promoting enterprise and economic development, this Council express its deep concern at the failure of Enterprise Ireland and the IDA to invite a representative of Sligo County Council to the joint Trade Mission attended by the new Minister for Jobs, Enterprise and Innovation, which took place in the Park Hotel, Sligo on the 18th of May 2016, and further the Council calls on the Chairman and Board of both Enterprise Ireland and the IDA to take the necessary steps to ensure that a representative of the Council is invited to such significant and import events held in Sligo in the future.”

 

44.  ILLEGAL DUMPING AT CONEY LANE, BALLISODARE:

“To call on Sligo County Council for a update report on the cleanup of illegal Dumping at a site at Coney lane in Ballisodare”.

Mr. Kilfeather reported that to the meeting that according to our records, two complaints were received in this office regarding illegal dumping at this site.  This was investigated by our Litter Warden who found a large amount of builders’ rubble and two couches in this scenic area.  No household rubbish was found at this time. He then contacted the General Area Supervisor to have the material removed. 

The General Area Supervisor confirmed this morning that the material in question was dumped approx 10 foot down an embankment and that it was very difficult to remove and didn’t know how it could be tackled.   He knows the area very well, it is on a public road R307 and he will look at it again.   He confirmed that it will be a dangerous operation to remove it and he will have to seek further advice on how to go about it safely.

Councillor Healy indicated that he might be in a position to assist with identifying an alternative access to this location and undertook to discuss same with the Director of Services.

 

45.  FOOTPATH ON COOLANEY TO COLLOONEY ROAD:

“To call on Sligo County Council to reinstate the footpath on the Collooney to Coolaney road”.

The Director of Services, Mr. T. Kilfeather, advised the Members that the Area Engineer is aware of the condition of the footpath at this location. The cost of replacing the footpath can be considered during the preparation of the 2017 Schedule of Municipal works for Ballymote/Tubbercurry Municipal District (along with other works proposed).

 

46.  SPEED LIMIT ZONE IN BALLYGAWLEY ON R290:

“To call on Sligo County Council to extend the speed limits zone in Ballgawley on the R290 out past the Castledargan hotel to address the health and safety concerns of the residents and users of this road”.

Mr. Kilfeather reported to the meeting that a Review of Speed Limit Bye-Laws for the County has commenced in accordance with the Department of Transport Guidelines for setting and managing Speed Limits in Ireland.

When the draft speed limits are published the public and other bodies may make submissions for consideration.

 

47.  SUP FOR ALL – TRAWANE BAY:

“Concerned with the closure of the SUPforall adventure sport business at Trawane Bay, and recognising the importance of Stand Up Paddling and other such adventure sports in attracting visitors to county Sligo, this Council calls on the Chief Executive to explain why legal proceedings were initiated against SUPforall, and further the Council asks the Chief Executive to make available to the elected representatives all documentation relating to the matter.”

Ms. Clarke reported to the meeting as follows:

“Complaints were received from a member of the public in July 2013 about a commercial activity at Trawane Bay.  This is immediately adjacent to the Lake Isle of Innisfree and the area is of scenic, cultural and of environmental significance.  An inspection was undertaken which found that paraphernalia associated with the business was strewn on the shoreline of the lake including tents, tables, chairs, portaloo, pallets and a large shipping container.  Access to lake shore via a public right of way was also obstructed by parked cars associated with this business.

A Warning Letter was served on 9th August 2013.  Discussions took place with the owner but commercial activity continued without planning permission and an Enforcement Notice was served on 28th of July 2014.  The matter was referred to our law agents on 12th November 2014.  Further complaints were received over the summer of 2015 in relation to congestion of the public car park for Innisfree car park and Sligo Way and the placing of unsightly polystyrene slabs on the lake to form a type of pontoon.

The case was mentioned in the courts from July 2015 until January 2016.  No planning application was lodged seeking to regularise this unauthorised development.  When the paraphernalia was removed in early 2016 we indicated that further court action would cease on payment of costs.  The case in respect of costs was heard in the District Court recently (7th June 2016).  The judge stated that the case would be struck out on payment of costs of €500.00 before the September court date.

The Enforcement notice and the warning letter are available for inspection by appointment in the Enforcement Section”. 

Mr. F. Moylan further advised the Members that correspondence sent, in confidence, by members of the public will not be made available and Members noted and agreed with this point. 

In reply to a query from Councillor Bree as to whether the local authority might have asked the owner to make a planning application, Mr. Moylan confirmed that the expectation was that a planning application was being prepared and was likely to be submitted. He noted that this development is located in a very sensitive area and the lake is a source of Sligo’s water supply. 

 

48.  ESTABLISHMENT OF TOWN AND BOROUGH COUNCILS:

“That this Council welcomes the commitment contained in the Programme for Government, that the new government will consider establishing Town and Borough councils subject to a local plebiscite and funding and further that the Council requests the Taoiseach and the new Minister for the Environment to indicate when it is likely that a firm decision will be made on the matter.”

 

49.  ROAD WORKS AT CLOONMULL LANE, DRUMCLIFFE:

“That Sligo County Council would resurface the road at Cloonmull lane, Drumcliffe, Sligo".

 

50.  CONSTRUCTION OF SOCIAL AND AFFORDABLE HOUSING:

“As Minister Coveney has now declared a housing emergency. This Council demands the monetary and non monetary resources to build 1,500 social and affordable housing”.

The Chief Executive advised the Members that with this matter could be dealt with at the Special Housing Meeting arranged for 11th July.  It was his opinion that there should be an update from the Department at that time.

 

51.  BAR ON FRACKING IN FUTURE COMMERCIAL AND/OR STRATEGIC DEVELOPMENT PLANS:

Training for the Governing Body of N.U.I.G.

Councillor Kilgannon advised the Meeting that Training for the new Governing Body is due to be held on 29th and 30th June, 2016.  It was agreed that this matter would be allowed on the Agenda of the A.G.M. on Monday, 20th June, 2016 as had been discussed at Item 15 earlier.
