Casual Trading
Open air trading of goods is covered by the Casual Trading Act 1995. Sligo County Council also enforces Casual Trading Bye Laws 2003, which cover this activity (see copy of Bye Laws below).
To be in compliance with these Bye Laws trading must not take place outside of the zoned areas/ bays and traders must hold a current and valid licence issued by the Local Authority.
For an annual fee, applicants are permitted to trade in one designated bay. This must be indicated on their application form and will also be stated on the issued licence.
Under the Casual Trading Act 1995 (Section 14) it is an offence to trade without a licence and outside the designated areas. Sligo County Council's Litter Warden, regularly patrols the trading areas.

BYE-LAWS
CASUAL TRADING ACT 1995
PART 1
Sligo County Council in the exercise of its powers under Section 6 of the Casual Trading Act, 1995, hereby makes the following Bye-Laws for the control, regulation, supervision and administration of the casual trading in its functional area.

These Bye-Laws may be cited as the Sligo County Council Casual Trading Act Bye-Laws.

In these Bye-Laws the following terms shall have the following meanings assigned to them, save where the context otherwise applies:

“The Act” means the Casual Trading Act, 1995.
-
“The Council” means the County Council of the County of Sligo.
-
“Functional Area” means the administrative area of County Sligo excluding the Borough of Sligo.
-
“Casual Trading” has the meaning given to it in Section 2 of the Act.
-
“Casual Trading Area” means those areas designated for casual trading in Bye-Law Number 3 hereof.
-
“Casual Trading Licence” means a licence granted by Sligo County Council pursuant to Section 4 of the Act.
-
“Stall” shall, in addition to its ordinary meaning, include any standing booth or space of any wheeled or moveable stall or box, barrow, cart, caravan or other vehicle or booth or other stand or conveyance used for casual trading.

“Goods” shall include all provisions or marketable commodities/services.

“Selling” shall include agreeing or offering to sell or displaying for sale or inviting an offer to buy
-
The expression “trader” shall mean any person or his agent authorised to carry on trading pursuant to these Bye-Laws.

The expression “Trading Bay” or “Space” shall mean an area outlined by Sligo County Council on which a stall may be placed within the Casual Trading Area or such other area as may be defined in a Casual Trading Licence.

“An event” means a Casual Trading Licence issued under Section 4(1)(a)(iii).
PART 2
DESIGNATION OF CASUAL TRADING AREAS

Casual Trading shall only be carried on, at the locations designated in the attached Schedule 1 or at areas specified in a Licence issued in respect of a specified event or event under Section 4 (1)(a)(iii) of the Casual Trading Act 1995.
CASUAL TRADING LICENCES
-
A person shall not engage in Casual Trading in the Council’s functional area, unless he/she holds a Casual Trading Licence granted by the Council, that is for the time being in force, and the Casual Trading is in accordance with the licence.

An application for a Casual Trading Licence shall be made on the prescribed Form and should be forwarded to the Environment Section, Sligo County Council, Unit 9 Cleveragh Business Park, Sligo, at least thirty days prior to the date on which it is intended to engage in Casual Trading.

The following fees shall be payable to the Council in respect of applications for Casual trading licences:

In the case of an application for a licence to engage in Casual Trading in the Council’s functional area for a period of twelve months, a fee of €507 or
-
In the case of an application to engage in Casual Trading in the Council’s functional area at an event or events specified in the application, a fee of €50 per day per stall.

Applications for licences must be accompanied by evidence of a current valid policy of insurance with a recognised insurance company and covering all activities associated with the purposes for which the Casual Trading Licence is to issue including all risks and perils to a minimum of €6,350,000 for any one incident, extending to provide an indemnity to the Council in respect of claims arising from the negligence of the Trader. Notice of termination of a policy shall render the said Casual Trading Licence null, void and of no effect and in which event the application including servants and agents of the applicant shall forthwith cease to trade and render the area vacant and returned to the control of Sligo County Council.

A person carrying on casual trading at any place shall:

Display the number of the Casual Trading Licence on the stall in such a position as to be clearly visible and easily legible to members of the public and
-
if so requested produce the licence on demand to any person.

Casual Trading shall only be licensed at locations specified and on the days and within the times specified in a Casual Trading Licence.

Casual Trading Licences will be subject to the conditions specified in Schedule 2 of these bye-laws and any additional conditions the Council consider necessary.

A Casual Trading Licence shall only authorise the person to whom it is issued to engage in Casual Trading, in the Council’s functional area or the agent of such person as agreed in writing by the Council.

The Council may appoint an authorised officer or officers, for the purpose of the Act and licence holders shall co-operate in all respects with the authorised officer(s).

A person who contravenes any of these bye-laws shall be guilty of an offence
and shall be liable on summary conviction to fines as specified in Section 14 of this Act, or such increased amounts as may be fixed by statues from time to
time.

These Bye-Laws shall come into operation on the 7th day of July, 2003.

SCHEDULE 1

Rosses Point – the entire length of the Western boundary of the car-park i.e. 50m long by 3.5m deep, but excluding access to the beach itself (10m wide) as outlined on attached map number 1.

Enniscrone -

At a distance of 250m from the stream West along the second beach, and the area between the dunes and the High Water Mark as outlined on attached map number 2.

Coolaney:-
Main Street, Coolaney, from junction of County Road 310 to junction of County Road 4 (all on Road 1) as outlined on attached map Number 4.

on each Thursday and Friday the areas marked A and B as outlined on map number 5.

The Southern boundary of the Church of Ireland property fronting on to Emmet Street as outlined on attached map number 7.

The Western frontage of the NCF cattle market fronting on to Fairgreen road as outlined on attached map number 7.
-
The Western side of Fairgreen Road from Clarry’s dwelling up to and including the Courthouse building as outlined on attached map number 7.

Riverstown
At the area known as The Diamond as outlined on attached map Number 8.
-
Dromore West at the area between the New-Buy Supermarket and the N.59 in Dromore West Village as outlined on attached map Number 9 and marked A.

on each Saturday and Sunday from 9.00 p.m. to 3.00 a.m.
SCHEDULE 2
CONDITIONS OF A CASUAL TRADING LICENCE
-
Only the licence holder or assistants shall engage in casual trading at the pitch number or area specified in the licence.
-
No goods other than those specified in the licence shall be sold.
-
Trading shall be confined to the allotted pitch and no goods or articles shall overhang a stall or be deposited on the street except inside the allotted pitch/area specified in the licence.
-
No stall shall exceed 2m in height, unless otherwise provided in the licence.
-
A person engaged in casual trading shall not obstruct or cause to be obstructed the entrance to any premises in the vicinity of the place where casual trading is taking place.

A person engaged in casual trading shall not cause or do any act or thing which interferes with the free flow of traffic or which would create a traffic hazard.
-
The type of stall to be used shall meet with the approval of the Council.
-
Traders in foodstuffs must comply with the requirements of the Environmental Health Inspector in relation to the statutory control of food.
-
A suitable receptacle for refuse must be provided by the licence holder and must be kept at all times of trading within the allotted pitch/area and shall be emptied regularly so as to avoid the creation of litter.

Stalls and all other articles must be removed from the street after the hours of trading specified on the licence.
-
The Council reserves the right to remove stalls found on the street after trading hours and/or goods or other articles left outside the allotted pitch/area at any time.
-
Litter must not be allowed to accumulate in the vicinity of the allotted pitch during trading hours. At the end of trading each day, the allotted pitch must be cleaned up and all refuse removed and properly disposed of by the licence holder.

While occupying a trading place a licence holder must obey all lawful requests of an authorised officer or a member of the Garda Siochana.

This licence may be revoked at any time if any condition of the licence has been or is being contravened or if the licence holder is convicted of an offence in relation to the importation, possession or sale of goods while he/she is the holder of a Casual Trading Licence, or an offence under Section 3 of the Casual Trading Act, 1995.
