Compulsory Acquisition of Land - Eastern Garvoge Bridge and Approach Roads


FORM OF NOTICE OF A COMPULSORY PURCHASE ODRER UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT, 1960, TO BE PUBLISHED IN ACCORDANCE WITH ARTICLE 4 (a) OF THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS AMENDED BY THE PLANNING AND DEVELOPMENT ACTS 2000 – 2006.


COMPULSORY ACQUISITION OF LAND


SLIGO BOROUGH COUNCIL COMPULSORY PURCHASE (No. 1) ORDER 2008
EASTERN GARVOGE BRIDGE AND APPROACH ROADS

Sligo Borough Council (hereinafter referred to as “the local authority”) in exercise of the powers conferred upon it by section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by section 10 of the Local Government (No.2) Act, 1960 as  substituted  by section 86 of the Housing Act, 1966 as amended by Section 6 and the Second Schedule to the Roads Act, 1993 and as amended by section 222  of the Planning and Development Act, 2000, and  pursuant to the powers conferred on it by the Planning and  Development Acts 2000 – 2006, has made an order entitled as above which is about to be submitted to An Bord Pleanála for confirmation. If confirmed, the order will authorise the local authority :-

  1. to permanently acquire compulsorily for the purposes of the orderly development and construction of  The Eastern Garvoge Bridge and Approach Roads, (the Scheme), the land described in Part I of the Schedule hereto and,
  2. to temporarily acquire compulsorily for the purposes aforesaid the land described in Part II of the Schedule hereto,
  3. to extinguish permanently all and any easements, wayleaves, water rights or other rights over or in respect of the land described in Part I of the Schedule hereto,
    which land is shown on the map entitled “Sligo Borough Council Compulsory Purchase (No. 1) Order 2008 Eastern Garvoge Bridge and Approach Roads” and numbered SBC/CPO/01/01 (3 Sheets), and sealed with the seal of the local authority and deposited at the offices of Sligo Borough Council, City Hall, Quay Street, Sligo, (hereinafter referred to as “the deposited map”).
  4. To extinguish the public rights of way described  in Part III of the Schedule hereto by order made after the acquisition of the land, where the said public right of way is over the land so acquired or any part thereof, or over land adjacent to or associated with the land so acquired or any part thereof.

Any objections to the extinguishing of the said public right of way should be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin 1, within 6  (six) weeks of the publication of this notice. An Observer fee of €50 must be paid in respect of any observations/submissions made to An Bord Pleanála in respect of this development.  This fee will not however apply to prescribed bodies as specified at articles 211, 213 or 215 of the Planning and Development Regulations 2001 to 2006 or to landowners and others with a legal interest in land who are objecting to compulsory acquisition of land in which they have such an interest in a compulsory acquisition case.

Owners, lessees and occupiers of the land described in the Schedule hereto will receive individual written notice.

If an objection is made in respect of the acquisition by an owner, lessee or occupier of the land, and not withdrawn, The Board may, at its absolute discretion, hold an oral hearing in relation to the matter.

If there is an objection to the extinguishment, which is not withdrawn, The Board may, at its absolute discretion, hold an oral hearing in relation to the matter.

An Environmental Impact Statement, for which separate public notice has been given, has been prepared in respect of the development which it is proposed to carry out on the land. Evidence in relation to the likely effects on the environment of the proposed development may also be heard at the oral hearing, if any.

A copy of the order and of the map referred to in it may be seen between the hours 9.30 a.m. and 4.30 p.m. Monday to Friday, excluding Public Holidays, at the offices of Sligo Borough Council, City Hall, Sligo.
